See here for Senator Reid's statement that says Burris "will not be seated by the Democratic Caucus," which I assume means the Democratic Caucus will vote not to seat him, rather than that they'll seat him in the Senate but just won't let him join the Democratic Caucus within the Senate. If there's some evidence that Burris's appointment was indeed the result of a bribe or some illegal maneuvering, then indeed the Senate can refuse to seat him.
