Plaxico Burress v. City of New York
RedState: Conservative News and Community —
... The WSJ has an interesting opinion piece written by David Kopel, of the Cato Institute. It discusses the recent news regarding Giants wide receiver Plaxico Burress and the incident in a New York nightclub where he possessed an unlicensed, in NY, loaded glock and he accidently shot himself in the leg. The point Mr. Kopel brings up is regarding New York City’s gun law, which states if a person is found to be carrying a firearm illegally, it carries a minimum three and a half year prison sentence, and how it punishes those that are discriminated by the state for not recognizing out ...

Hit & Run —
Second Amendment scholar Dave Kopel in the Wall Street Journal: New York Giants star receiver Plaxico Burress is facing a mandatory 3½ years in prison and the end of his football career. His crime? Not having a license, which New York City never would have issued him, for the exercise of his constitutional right to bear arms. To be sure, Mr. Burress got caught because of what appears to have been stupid and irresponsible behavior connected with the handgun. But he does not face prison for shooting himself. His impending mandatory ...

Dave Kopel , writing in the WSJ, takes up the defense of the knuckle-headed Plaxico Burress , star wide receiver for the NY Giants who shot himself in the thigh while carrying a concealed weapon in Manhattan sans permit. His gist - the constitutionality of the NYC permit laws could be successfully challenged as violating the Second Amendment. Left unmentioned - since he is battling for his freedom and a $35 million five year contract, Mr. Burress has the money and incentive to see this fight through. And that suggests that prosecutors may prefer to settle for the sure ...
Don’t Free Plaxico Burress
The Sundries Shack —
It’s a bad idea to make Plaxico Burress the newest poster child for Second Amendment rights. Dave Kopel gives it a noble try in today’s Wall Street Journal, but I think he misses something important. His main point, that the plain language of the 2nd Amendment and the recent SCOTUS Heller decision make New York City’s gun ban (and Burress’ criminal charge for merely possessing a handgun) unconstitutional are, I believe, right on. However, Burress did endanger lives with his negligent handling of his firearm and I think he’s fortunate that he wasn’t charged with something more ...

Free Plaxico! WSJ Columnist Discusses Arbitrariness and Unconstitutionality of NYC's Gun Laws First, how stupid could Plaxico be? This stupid: It appears that he put the unholstered gun in the waistband of his sweatpants, and when it slipped, he grabbed for it, accidentally hitting the trigger. To make matters worse, according to press accounts, he was seen drinking and may have been consuming alcohol -- which all firearms safety training (including the class he would have been required to take for his Florida permit) absolutely forbids for people handling ...
