... system would look like have already started. "It would have to be some sort of hybrid that involves military commissions that actually administer justice rather than just serve as kangaroo courts," Tribe said. "It will have to both be and appear to be fundamentally fair in light of the circumstances. I think people are going to give an Obama administration the benefit of the doubt in that regard." What do you think, should "the people" give Obama the benefit of doubt? The article is here . Posted by Ziva at November 10, 2008 09:03 AM Comments Post a comment

AP reports on the president-elect's options concerning the Gitmo detainees. Bringing the terrorists to the U.S. will produce consequences that will begin to roll up immediately, not the least of which will be the cost associated with the merger of the military tribunal system into the criminal justice system. The safety of the terrorists within the U.S. prison population will also become an issue, as will release issues. The rhetoric of "closing Gitmo" is just the first instance where the reality of governing will prove much more difficult than that of campaigning. While ...

“Obama planning US trials for Guantanamo detainees”

Lovely ! President-elect Obama’s advisers are quietly crafting a proposal to ship dozens, if not hundreds, of imprisoned terrorism suspects to the United States to face criminal trials, a plan that would make good on his promise to close the Guantanamo Bay prison but could require creation of a controversial new system of justice. During his campaign, Obama described Guantanamo as a “sad chapter in American history” and has said generally that the U.S. legal system is equipped to handle the detainees. But he has offered few details on what he planned to do once the facility is ...

By Thoreau Apparently there are plans to hold trials for Gitmo detainees . I will move away from cynicism and adopt a patient wait-and-see approach. I admit that I am worried about some of the discussions of special new courts that can handle secret evidence, but I’ll at least wait and see whether the Star Chambers materialize. Hat tip to ...

... In the works as AP reports the Obama transition team is working on a plan to ship Guantanamo detainees to the United States for trial. A move that apparently will require a controversial new system of justice. Release for some, U.S. criminal trials for others, and some new, special system to handle sensitive national security cases … hey, that doesn’t sound very American. Sounds a little like a Cheney-Bush Star Chamber. Though a hybrid court may be unpopular, other advisers and Democrats involved in the Guantanamo Bay discussions say Obama has few other options. AP ...

The AP reports an officially unofficial leak from the Obama team that closing Gitmo is a priority for the new administration. Under plans being put together in Obama's camp, some detainees would be released and many others would be prosecuted in U.S. criminal courts. That's good. This bit isn't so good: A third group of detainees — the ones whose cases are most entangled in highly classified information — might have to go before a new court designed especially to handle sensitive national ...

... set up in Afghanistan, Thailand, Eastern Europe and elsewhere? What about the CIA torture flights? Will those end too? Closing Gitmo also raises questions over how "high value" defendants will be handled. Your administration is reportedly considering setting up an alternative court system to deal with sensitive cases. But what safeguards will be in place to be sure that this new system won't degenerate into kangaroo courts, like Bush's military commissions? It's a disturbing signal that you've appointed John Brennan, who has supported extraordinary rendition and ...
