Holder voids Stevens conviction
News —
... NPR is reporting that Attorney General Eric Holder will withdraw the indictment of Ted Stevens due to prosecutorial misconduct. Nina Totenberg writes that Holder knows the trial judge, Emmet Sullivan, well, and has watched in horror as Sullivan has repeatedly criticized prosecutors for their actions. Sentencing has been repeatedly delayed. By last month, it was playing a back seat to charges of prosecutorial misconduct — as a whistle-blowing FBI agent made complaints about improper conduct by a fellow agent and prosecutors. With a hearing scheduled in two weeks to explore ...

The Department of Justice must always ensure that any case in which it is involved is handled fairly and consistent with its commitment to justice. ... motivated prosecutions. While Stevens may or may not have committed a crime, he was deprived of a fair trial by prosecutors who knowingly and in defiance of court orders withheld relevant documents and information in order to secure a conviction of a high-profile Senator. The result was not just a wrongful conviction, but a change in the overall structure of our political process which will have implications for decades if Begich becomes the deciding vote on Obama's agenda.
