NPR Shocker: Attorney General Holder Stumped By Lindsey Graham
NewsBusters.org - Exposing Liberal Media Bias —
During Wednesday's Justice Department oversight hearing by the Senate Judiciary Committee, Sen. Lindsey Graham (R-S.C.) stumped Attorney General Eric Holder on what should have been a fairly routine question for America's top law enforcement official. Maybe more surprisingly, NPR reported it at its website. As NPR's Frank James noted, "The exchange started with Graham stumping Holder with a question one would have thought the attorney general would have been prepared for." I quite agree (video embedded below the fold with partial transcript, h/t Steve ...
today’s wedgie
Knowledge is Power —
give a listen...this is goooood
SENATOR LINDSEY GRAHAM, (R-S.C): Can you give me a case in United States history where a enemy combatant caught on a battlefield was tried in civilian court?
ERIC HOLDER, ATTORNEY GENERAL: I don’t know. I’d have to look at that. I think that, you know, the determination I’ve made --
GRAHAM: We’re making history here, Mr. Attorney General. I’ll answer it for you. The answer is no.
Lindsey Graham devastates Eric Holder.
Althouse —
Crushing: Holder imagines that he can hide inside that "thoughtful" routine that Obama so often relies on, but it is utterly pathetic here. Either he knows damned well what he's doing and he's lying or he's outrageously unqualified for his job. His similarity in evasive style is so similar to Obama's that he makes Obama look worse. ...
Eric Holder Looks Amateurish and Unprepared
Wizbang —
There's been a lot of discussion here at Wizbang and across the country about the Obama administration decision to try Khalid Sheik Mohammed in a federal court. If you haven't seen it, here is a video of Lindsey Graham taking Holder to task for the decision. I'm no fan of Graham but in this video he shows a knowledge of history and the damage being done to it. Holder shows himself to be nervous and unprepared to attend the hearing let alone make critical executive decisions. Ann Althouse is spot on ...
Reading Bin Laden His Rights
Power Line —
Lindsay Graham frequently drives us crazy, but it can't be denied that he has his moments. In today's Senate Judiciary Committee hearing, he took Eric Holder to the woodshed:
Graham is right, of course. Under the Obama administration's policies, if we capture Osama bin Laden tomorrow, the first thing we will have to do is read him his rights, and the second is get him a lawyer at taxpayer expense. The argument that Holder tries to interpose--maybe we won't have to Mirandize bin Laden because the evidence of his guilt is "overwhelming"--is pathetic. Can you ...
Oh, Snap! Graham Slams Holder
THE ASTUTE BLOGGERS —
Graham damn near redeemed himself today. Classic. Holder's a troofer. His argument that KSM should be tried in civilian court because he killed civilians is simply false. That's 100% legally irrelevant. You don't get sent to juvenile court if you kill a child. Furthermore, KSM attacked the Pentagon, which is US military headquarters, so Holder's non-point is further nullified by his own non-argument in favor of it. He's doing this because he's a troofer and a typical leftist terrorist-lover. ...

The prosecution of KSM: It is obvious Eric Holder has not thought it through
TigerHawk —
Watch this selection from Eric Holder's Senate testimony on the use of the civilian criminal justice system to try jihadis who kill Americans. Leaving the substantive arguments to Andy McCarthy, who has just been beating the hell out of them over at The Corner for days, how is it possible that Holder was not ready for the Miranda question? Boggles my mind. 0 Comments: Post a Comment This page is powered by Blogger. Isn't yours? Weblog Commenting and Trackback by HaloScan.com [image] [image]
Further Thoughts On The Khalid Sheikh Mohammad Show Trial
Below The Beltway —
It’s becoming more and more apparent that the Obama Administration’s decision to try Khalid Sheikh Mohammad in a civilian court has little to do with actual justice.
Consider for example this exchange between Senator Chuck Grassley and Attorney General Holder:
Sen. Charles Grassley (R., Iowa): “I don’t think you can say that failure to convict is not an option, when we have juries in this country.”
Attorney General Eric Holder: I have thought about that possibility. Congress has passed legislation that would not allow the release of these individuals in this country. If there is not a successful conclusion to this ...

Commonsense & Wonder —
SENATOR LINDSEY GRAHAM, (R-S.C): Can you give me a case in United States history where a enemy combatant caught on a battlefield was tried in civilian court? ERIC HOLDER, ATTORNEY GENERAL: I don’t know. I’d have to look at that. I think that, you know, the determination I’ve made -- GRAHAM: We’re making history here, Mr. Attorney General. The Corner on National Review Online —
For those of us frustrated with Graham, this makes up for a lot.
Thinking It Through
Neptunus Lex —
AG Holder fails to do so.
NPR – shockingly – calls him on it.
GRAHAM: If we captured bin Laden tomorrow, would he be entitled to Miranda warnings at the moment of capture?
HOLDER: Again I’m not — that all depends. I mean, the notion that we –
GRAHAM: Well, it does not depend. If you’re going to prosecute anybody in civilian court, our law is clear that the moment custodial interrogation occurs the defendant, the criminal defendant, is entitled to a lawyer and to be informed of their right to remain silent.

Lindsey Graham gives Eric Holder a law lesson
neo-neocon —
This is a very different Lindsey Graham from the one we’re used to. This Lindsey Graham is sharp and articulate, charged with righteous outrage at Eric Holder and Barack Obama’s unjustifiable decision to try KSM in a civilian criminal proceeding.
Heck, Holder doesn’t even really make an attempt to justify it. Even if you didn’t think much of Holder before, it remains shocking to see how extraordinarily little he appears to have thought about the legal issues involved. He has no answer for Graham, and he seems to sense early on in the questioning that he’s caught in a trap, and can find no way out.
It’s ...
Lindsay Graham (Yeah, I Know) Destroys AG Eric "Nation Of Cowards" Holder On Civilian Trials For Terrorists
Ace of Spades HQ —
Lindsay Graham (Yeah, I Know) Destroys AG Eric "Nation Of Cowards" Holder On Civilian Trials For Terrorists I'm second to no one in my loathing of Lindsay Graham's style of 'make a deal and get something done' politics but my guess is he's a hell of a lawyer. There are a lot of knocks on Eric Holder but no one really thinks he's a stupid man. Misguided? Sure. Diagnosably retarded? No. Watch this exchange between Graham and Holder. Graham leaves Holder stammering like a fool. Here's the crap Holder is trying to sell that Graham won't let him get away with...Holder says, 'we don't need to question bin Laden because we have so much evidence already so we won't question ...
Sen. Graham knocks around AG Holder on KSM.
RedState —
I know that Senator Lindsey Graham (R, SC) is not on a lot of people’s Christmas card lists, but this exchange between him and Attorney General Eric Holder was four minutes, forty seconds’ worth of pure schooling:
Not filmed was the bit in the end where Holder was on the floor, looking for his teeth. You do not walk into a situation like that without an elementary knowledge of the relevant historical record*. You do not come completely unprepared for a obviously-telegraphed question like “So. What are you going to do with a ...

Riehl World View —
Tell me these incompetent political hacks like Obama and Holder aren't putting America at greater risk? Our enemies have to be laughing their azzes off in their caves at the crew they find themselves up against.
And any street hood could probably tell you this is a one way ticket to freedom for terrorists who have already killed Americans. It's so unbelievably ...
Lindsay Graham TKOs Eric Holder
baldilocks —
Everyone has it so I might as well post it--especially since it's so nicely done by Senator Graham. Stacy McCain reminds us why the senator know what he's talking about : Graham decided to join the United States Air Force in 1982, and served on active duty until 1988. Following his departure he stayed in the military, joining the South Carolina Air National Guard and the U.S. Air Force Reserves. During the Gulf War, he was recalled to active duty, serving as a Judge Advocate at McEntire Air National Guard Station in Eastover, South Carolina, where he helped brief departing pilots on the laws of war. The thing is, the points which Senator ...
KSM civilian trial: Did Holder think it through?
Fausta's Blog —
Watching this video, you can’t help but wonder if Eric Holder gave much thought to the decision:
How could Holder not know the answer to this question?
Noel Sheppard (via Instapundit) has the transcript. Money quote:
The big problem I have is that you’re criminalizing the war, that if we caught bin Laden tomorrow, we’d have mixed theories and we couldn’t turn him over — to the CIA, the FBI or military intelligence — for an interrogation on the battlefield, because now we’re saying that he is subject to criminal court in ...
BlogTalk: Miranda Rights and Health Care
The Caucus —
Much of the blog discussions today are about the Senate Democrats’ proposal to overhaul the health care system, which was released late yesterday. Coming in at 2,000-plus pages, the document, available here, would be hard for anyone to read in its entirety between now and Thanksgiving. So we’ll lead you to some thoughtful disucssions on the blogs about what to look for and how to analyze it in a while. But first, another subject that is receiving a lot of traffic today is Attorney General Eric H. Holder Jr.’s testimony before the Senate yesterday on the decision to try the co-conspirators in the 9/11 attacks in federal court in Manhattan, instead of ...

Eric Holder’s Very Bad, Posterized Day
The Sundries Shack —
I’ve been meaning to write a couple posts about Attorney General Eric Holder’s testimony before the Senate Judiciary Committee earlier this week, but other oblgiations have imposed themselves on me. However, there are a couple points I want to share. Before I do that, I want to note that the progressive already had their go-to talking point — we on the right are somehow frightened of Khalid Sheikh Mohammed — fully deployed. Sister Toldjah ...

John King: AG Holder Refused To Admit KSM's Trial Sets Precedent
NewsBusters.org - Exposing Liberal Media Bias —
CNN's John King on Thursday claimed Attorney General Eric Holder intentionally avoided Sen. Lindsey Graham's "stumping" question during the previous day's Senate Judiciary Committtee hearing because he didn't want to admit that trying Khalid Sheikh Mohammed and other 9/11 suspects in a criminal courtroom is indeed precedent setting. As NewsBusters reported Wednesday, Holder appeared stumped when Graham asked, "Can you give me a case in United States history where a enemy combatant caught on a battlefield was tried in civilian court?" Speaking with WOR radio's Steve Malzberg Thursday, King said, "He knew the answer to ...
Graham Flunks History: Noriega Tried in Federal Court
Serious Implications —
“We’re making history, bad history.” – Senator Lindsey Graham
Last week, in the wake of the Justice Department’s decision to try alleged 911 mastermind Khalid Sheikh Mohammed in a New York federal court, Senator Lindsey Graham challenged a badly stuttering Attorney General Eric Holder:
Graham: “can you give me a case in United States history where an enemy combatant caught on a battlefield was tried in civilian court?”
Yes we can.
Holder was not prepared for the question, hesitated, and Graham ...
So sue me!
Belmont Club —
Fox News reports that Navy Seals who captured the mastermind of the attack on the Blackwater convoy through Fallujah in 2004 are being sued by their captive for punching him. Navy SEALs have secretly captured one of the most wanted terrorists in Iraq — the alleged mastermind of the murder and mutilation of four Blackwater USA security guards in Fallujah in 2004. And three of the SEALs who captured him are now facing criminal charges, sources told FoxNews.com. The three, all members of the Navy’s elite commando unit, have refused non-judicial punishment — called an admiral’s mast — and have requested a trial by court-martial. Ahmed Hashim Abed, whom the military ...
From the WSJ: The President's Bank Reforms Don't Add Up: Restricting loans to real estate virtually guarantees another bank crisis in the future.
Peppered with Salt —
"This is not a good trend, because the real-estate sector is highly cyclical and volatile. It was, indeed, the vast number of subprime and other risky mortgages in our financial system that caused the weakness of the banks and the financial crisis. Requiring banks to continue to lend to real estate, because they have few other alternatives, virtually guarantees another banking crisis in the future." ...

The Sad Truth about the Obama Child Tax Credit
Peppered with Salt —
There's been a lot of buzz in the press about the White House's idea to increase the child tax credit. What people misunderstand is that this is not an expansion of the per child tax credit that FRC drafted back in 1994. The Child and Dependent Care Tax Credit would only benefit families if: both parents work, a single parent works, or one parent works and the other is in school. In other words, it completely discriminates against families with stay-at-home parents, who wouldn't see a penny from this plan. Experts are saying this is the administration's attempt at "socialized child care." ...

I got a call from Senator Claire McCaskill’s office today. Allow me to say that while I probably don’t agree on a lot of issues with the Senator, her staff has been incredibly helpful and responsive. Double thumbs up to the Senator and her team on this.

Some Key Issues to Know...Including "TRICKLE DOWN TAXES"
Peppered with Salt —
Verify the following for yourselves:
Obama budget proposal is 3.8 trillion dollars (at least 1.6 trillion beyond tax receipts for the year).
REMEMBER THE LAW OF "TRICKLE DOWN TAXES": Obama increases taxes on couples and singles making 250,000 or more. History shows that this is only a STARTING place. Beyond hidden taxes for the middle class and working poor (gas, cigarette, food, etc., etc., etc....), watch for the Bush tax cuts to be recinded (which affects the average middle class). Also, look for tax increases in social security and for lower income brackets. Oh, and don't forget, if Obamacare occurs, don't forget the taxes that ...

When Congress passed tax relief for families in 2001 and 2003, some Members of Congress insisted the tax cuts be staggered and temporary, resulting in a large scheduled tax hike in 2011.
If these cuts are not made permanent, next year American families will face one of the largest tax increases in history. On average, taxes would increase $1,800 per taxpayer, and 48 million married couples will face an average hike of ...
